FAMILY LAW PROPERTY DISPUTES

A property settlement can take place at any time before you are divorced but must be applied for within one year of your divorce. The court takes many factors into account in assessing what is a proper settlement; these factors include home making and parenting as well as financial issues. Future needs and past contributions made by the parties involved are also taken into account. In certain situations, the court may order a spouse to maintain their former partner by way of maintenance payments.
